SMS Opt-In Flow

Effective date: May 15, 2025  ·  Totally Legitimate Business, LLC (DBA TLB Cloud)

1. Overview

This document describes how Gerald collects SMS consent from the clients and customers of subscribing businesses. Consent is collected verbally during the intake call or in-person visit between the client and the subscribing business. No web form or digital signature is used.

higerald.com is a pre-launch marketing page. There is no public SMS sign-up on this site. All numbers messaged through Gerald are collected by the subscribing business as part of an established client relationship.

2. Step 1 — Client contacts the subscribing business

An existing client contacts the business for an intake, onboarding, or service agreement. The client provides their phone number as part of this process.

3. Step 2 — Staff delivers verbal consent disclosure

Before any phone number is recorded for use with Gerald, staff delivers the following verbal disclosure during the intake conversation:

“We use a texting platform called Gerald to send you appointment reminders and updates. By providing your phone number today, you agree to receive these messages from us. You can reply STOP at any time to opt out.”

Script delivered verbally by staff during the intake call. No web form or digital signature required.

4. Step 3 — Consent and phone number recorded in CRM

The client's phone number and verbal consent are recorded in the business's case management or CRM system at the time of the call. No messages are sent before this step is complete.

5. Step 4 — Gerald sends welcome message

Once consent is recorded, Gerald sends a welcome message confirming the opt-in and providing opt-out and help instructions on first contact. Example message:

Welcome to Gerald, the communication platform for [Business Name]. You may receive appointment reminders and updates from us at this number. Reply STOP to opt out. Reply HELP for help. Msg and data rates may apply. Terms: higerald.com/terms | Privacy: higerald.com/privacy

6. Opt-out and ongoing rights

Clients may opt out at any time by replying STOP to any message from Gerald. No further messages are sent once an opt-out is received. Clients may reply HELP at any time to receive assistance and contact information for the sending business and Gerald support at legal@higerald.com.

Message frequency varies. Message and data rates may apply. For full terms governing SMS communications through Gerald, see the Terms of Service and Privacy Policy.
