Gerald is a client communication platform operated by Totally Legitimate Business, LLC, doing business as TLB Cloud, a limited liability company registered in the State of South Dakota, with its principal place of business in Rapid City, South Dakota (Pennington County).

This Privacy Policy explains how we collect, use, store, and protect information when you use Gerald, including when you receive SMS communications sent through our platform on behalf of a business you have a relationship with.

2. Information We Collect

We collect information in the following ways:

Information provided by businesses using Gerald:

• Business name, contact information, and account credentials
• Client and customer names, phone numbers, and email addresses provided for the purpose of sending communications
• Matter, case, or record identifiers imported from connected platforms such as Clio or Monday.com
• Appointment and calendar data imported from connected platforms

Information generated through platform use:

• SMS message content, timestamps, and delivery status for messages sent and received through Gerald
• Appointment confirmation, cancellation, and reschedule responses
• Inbound and outbound call logs including originating number, destination number, and call timestamp
• Usage data including login activity, feature usage, and session information

Information collected automatically:

• IP addresses and browser or device information when accessing the Gerald web application
• Cookies and similar tracking technologies used to maintain session state and improve platform performance

3. How We Use Your Information

We use the information we collect to:

• Deliver SMS messages, appointment reminders, and other communications on behalf of businesses using Gerald
• Route inbound messages and calls to the appropriate business and matter thread
• Log communications to connected third-party platforms including Clio and Monday.com as configured by the subscribing business
• Maintain and improve the Gerald platform
• Detect and prevent fraud, abuse, and violations of our Terms of Service
• Comply with applicable legal obligations
• Provide customer support and respond to inquiries

We do not sell your personal information to third parties. We do not use personal information transmitted through Gerald for advertising or marketing purposes.

4. SMS Communications and Consent

Gerald sends SMS messages on behalf of businesses to their existing clients and customers. If you receive an SMS through Gerald, it means a business you have an established relationship with has sent you a message using our platform.

Opt-out requests are processed immediately. Once you reply STOP, no further messages will be sent to your number from that business through Gerald unless you re-establish consent directly with the business.

Gerald does not send unsolicited messages. All messages sent through the platform are transactional and operational, sent in connection with an existing client relationship established by the subscribing business.

Message frequency varies depending on your business relationship and activity. You may receive appointment reminders, status updates, and responses to your messages. Message frequency is determined by the subscribing business and the nature of your engagement with them.

Mobile number non-sharing statement: Your mobile phone number will not be shared with third parties or affiliates for marketing or promotional purposes. Phone numbers collected through Gerald are used solely to deliver transactional communications on behalf of the subscribing business. We do not sell, rent, lease, or trade mobile phone numbers to any third party under any circumstances.

5. How We Share Information

We share information only in the following circumstances:

• With service providers: We use Twilio to deliver SMS messages and handle voice calls. Twilio processes message content and phone numbers as necessary to deliver communications. Twilio's privacy policy governs their handling of this data.
• With connected platforms: When a business configures Gerald to log communications to Clio, Monday.com, or other integrated platforms, message content and metadata are shared with those platforms as directed by the subscribing business.
• With the subscribing business: All communications sent and received through Gerald on behalf of a business are visible to authorized staff of that business through the Gerald platform.
• For legal compliance: We may disclose information when required by law, subpoena, court order, or other legal process, or when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, or investigate fraud.
• In a business transfer: If TLB Cloud is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will provide notice before your information is transferred and becomes subject to a different privacy policy.

We do not sell, rent, or trade personal information to any third party for their own marketing purposes.

6. Data Retention

We retain communication records, message logs, and account data for as long as a business account is active and for a reasonable period thereafter to comply with legal obligations, resolve disputes, and enforce our agreements.

Businesses may request deletion of their account and associated data by contacting us at legal@higerald.com. We will process deletion requests within 30 days subject to any legal retention requirements.

SMS opt-out records are retained indefinitely to ensure compliance with carrier requirements and to honor opt-out preferences.

7. Data Security

We take reasonable technical and organizational measures to protect the information we collect and process. These measures include encrypted data transmission, access controls, and secure storage practices.

However, no system is completely secure. We cannot guarantee the absolute security of your information. If you believe your account has been compromised, contact us immediately at legal@higerald.com.

8. Your Rights

Depending on where you are located, you may have certain rights regarding your personal information, including:

• The right to access information we hold about you
• The right to correct inaccurate information
• The right to request deletion of your information
• The right to opt out of SMS communications by replying STOP

9. Children's Privacy

Gerald is not directed at children under the age of 13. We do not knowingly collect personal information from children under 13. 10. Third-Party Links and Services

Gerald integrates with third-party platforms including Clio, Monday.com, and Twilio. This Privacy Policy does not cover the privacy practices of those third parties. We encourage you to review the privacy policies of any third-party services you connect to Gerald.

11. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will update the effective date at the top of this page. For material changes, we will provide additional notice such as an in-platform notification or email to the account holder. Continued use of Gerald after any changes constitutes your acceptance of the updated policy.
